TO ALL LE BARON UNIT OWNERS:

Subject:         Le Baron Parking Lots Surface Replacement Project

Enclosed is a form that allows the unit owners to vote to approve the proposed alteration of the common element parking/driveway areas of Hillsboro Le Baron Condominium Apartments, Inc. by Written Consent.  Please note the common element alterations with brick pavers have been approved by the Board of Directors. This letter is to request that you vote by return mail on a proposal to replace our old blacktop in the driveways and parking areas with brick pavers.

The Board has been advised that to change the existing paving from blacktop paving to brick pavers, requires the approval of seventy-five (75%) of all Le Baron owners.

As a result of wear, neglect, the concrete restoration project and the lack of proper maintenance over the years, both the East and West parking lots need new paving.  The main reason for switching to brick pavers is not simply a matter of appearance, but rather to cut down on the frequency of blacktop repairs and expenses over time.  We are advised that the blacktop paving should be sealed each year at an estimated yearly cost of $15,000.

The Board has obtained pricing from brick paving contractors and the low price results in a total project cost of $225,000. The quotation for brick pavers is good only if the project is completed before the end of 2007.  Total installation time is estimated to be three (3) months.

The cost of the brick pavers could be financed by our bank line of credit and delay an assessment of the cost of $1,500 dollars per unit until 2008, if you so desire.

The Board of Directors at its June 25, 2007, meeting approved a $1,500 assessment with suggested split payments in thirds of $500 on October 1, November 1 and December 1, 2007, if you do not desire to use our bank line of credit to delay an assessment until 2008.

Your Board of Directors were requested by the majority of the owners present at the May 24,2007, and the June 25, 2007, board of directors meetings, to replace the asphalt parking lot surfaces with brick pavers in lieu of blacktop paving that currently exists.

The manufacturer has suggested the brick pavers be installed in an earth tone color.  After an initial sealing, three months after installation, sealing is not anticipated to be required again for several years.  Maintenance for brick pavers is anticipated to be far less that maintaining blacktop paving and much more pleasing to view.

The pavers will be striped with cream brick pavers to separate parking spaces. The brick pavers are quoted to be of sufficient thickness, with concrete sand bedding, to withstand the daily truck traffic received at the Le Baron parking lots.

Your Board has also obtained quotations on blacktop paving, as the lots now exist.

The most responsible blacktop paving low bidder’s project cost is estimated to be $185,000 dollars. Blacktop paving requires yearly maintenance and sealing of the surfaces, which has not been done in the past.

Due to the large upfront deposit required by blacktop paving contractor an assessment would have to be made all at one time, early in the fall, to pay the cost of blacktop paving.  This assessment is estimated to be in the area of $1,150.

With current rising oil prices we cannot predict the escalation cost of blacktop paving.

Your Board recommends the Le Baron Owners vote in the affirmative to replace the existing blacktop parking lot paving with brick pavers.

A 60-day Notice of Consent is included with this letter and is a ballot to vote to approve the installation of brick pavers in lieu of asphalt paving.

A photograph is included with this letters showing the color of brick pavers to be used in the paving project.

Please note that the proposed common element alteration is presented to you for approval in the form of Written Consent in lieu of a meeting of the membership.  This method, which is provided for by Florida law, is more cost-effective for the Association, and a more convenient procedure for the membership, to vote on the proposed common element alteration.  The required votes for approval to alter the common elements does not change because the vote is taken by Written Consent instead of a meeting of the membership.  In order to have your vote counted, you are encouraged to return the enclosed form by the deadline stated at the bottom of the form.  Of course, if you have any questions, please contact the Association in writing at the above address.

Please return your enclosed Written Consent Form by September 1, 2007, in order that the project may be completed by winter season.
